MOUNTAINS OF PUBLIC UTILITY
It is a mountain included in the Catalog of Forests declared as of the Public Utility of the Spanish State. They are often referred to by the acronym M.U.P. The forest public domain is made up largely of these mountains, in addition to the communal ones, while their use corresponds to the common of the neighbors, as well as those affected by a public use.
Conditions for a lot to be declared of Public Utility
According to the legislation of the Spanish state, the autonomous communities are included in the Catalog of amounts of public utility of the public hills included in the following assumptions:
Declarations may be made to protect forests or forest lands owned by public or private property that have been included in the following cases
- A) That they fulfill some of the following conditions written here:
- Those located in headwaters of river basins and others that contribute decisively to the regulation of the hydrological regime, avoiding or reducing avalanches, floods and defending populations, crops or infrastructures.
- That they are in the areas of priority action for soil conservation work in the face of erosion and hydrological-forest correction processes, and in particular the continental dunes.
- That they avoid or reduce landslides or rocks and the grounding of reservoirs and that protect crops and infrastructure against the wind.
- That they are in the perimeters of protection of the surface and underground water abstractions.
- They are part of these river segments of environmental interest included in the watershed hydrological plans.
- Those others that determine the autonomic legislation.
- It is located in designated forest areas of protection within a Natural Resources Management Plan or a Forest Resources Management Plan in accordance with the provisions of article 31 of this law.

- B) Those who felt satisfied in their present state the characteristics of the forests protect or with other figures of the special protection, are directed to the restoration, reforestation or forest improvement with the fines of protection of those.
- C) Those others that establish the autonomous community in its legislation.
Declaration of other figures of special protection
The declaration of other figures of special protection of the mountains is made by the forest administration of the autonomous community, the previous record in which, in any case, becomes the owners and the local entity where they reside. The same procedure of follow-up for the declassification of once the circumstances that determined its inclusion would have disappeared. The autonomous communities establish other figures of special protection of the mountains of the public or private ownership that presents, among others, some of the following characteristics :
- They contribute to the conservation of biological diversity, through the maintenance of ecological systems, the protection of flora and fauna or the conservation of genetic diversity.
- They constitute or form part of protected natural areas, areas of the Natura 2000 Network, biosphere reserves or other legal protection figures, or are located in their areas of influence, as well as the constituent elements of landscapes.
- That it is included within the zones of high risk of fire according to the established in article 48.
- Because of the special significance of their forest values.
- Those others that determine the autonomic legislation.
